Marriage in Islam with the Selection of Spouse

Marriage is a legal contract that enables each spouse to have enjoyment with the other. Marriage is an integral part of a Muslim’s life, indeed it is too important in our religion Islam that it is considered to be one half of one’s Faith. Marriage is the lawful and legitimate way to indulge in intimacy between a man and woman. Marriage is a great virtue and means of salvation in religion Islam. Marriage is a contract made by male and female to live together as wife and husband in order to strengthen their relationship. Allah Almighty mentioned in the Holy Quran: “And marry those among you who are single and (also marry) the Saliheen (pious) of your (male) slaves and maidservants.” (Quran, 24:32). 



Marriage is an act of Sunnah. There are many Ahadith that instruct us to get married. Our beloved Prophet Muhammad (PBUH) himself got married and encouraged others to marry too. It is obligatory for whoever has the means to do so and a fear committing what is forbidden. It has been reported that the Holy Prophet (SAW) said: “O young men! Whoever among you can afford it, let him get married, for it is more effective in lowering the gaze and guarding chastity.” (Al-Bukhari 5065)

Marriage is a way to acquire spiritual perfection and also married people remain healthier physically and mentally. When a Muslim gets married he/she fulfills the religious obligation and duty. Through marriage fulfill the need of each spouse by the other, in order to maintain their chastity by satisfying natural sexual desires. It is an essential element in the proper and actual upbringing of children. Marriage safeguards from the sins of fornication, homosexuality, and masturbation.


Selection of Spouse


In order to get married the spouse selection should be based on basically religiousness in addition to this below, we are going to discuss some things that need to be considered while selecting a spouse.


  • The spouse should be pious with whom someone is getting married.
  • The spouse should be religious.
  • One should have a good nature. He/she should be patient during difficulties that may arise in married life.
  • The marrying partners should be compatible with each other.
  • The Messenger of Allah Holy Prophet (SAW) has given great emphasis on taking into consideration a good family background when someone intends to get married.
  • Though a spouse should be piety and religious but with that one should also consider the physical and mental health.

There should be love, respect, care, honesty, mercy, confidentiality, and selflessness in marriage if someone wants to live a happy married life. May Almighty Allah guide us to the right and make us capable to act upon His commands and to follow the Sunnah of His beloved Prophet Muhammad (PBUH). Ameen

Basic Rights of Wives in Islam | According to Quran and Hadith

Islam is the complete code of life. According to Islam family makes up the society. The family is formed of man and woman and it is extended by producing children. After getting married it’s the responsibility of the husband to take care of his wife in all aspects. Every Muslim must realize that one’s spouse is first and foremost on another. It’s the duty of all Muslims that they should give respect to one another. Husband and wife have been greater rights upon each other because they have to live together.




Husband and wife should strive to make one another happy and take into consideration the needs, abilities, and weaknesses of the other. Our beloved Prophet (PBUH) advised the husbands to treat their wives in the best way. This is clear in the following hadith: “The best of you is the best of you to their family and I am the best of you to my family.”

In another hadith Holy Prophet (SAW) said: “I entreat you to treat women well for they have been created from a rib and the most crooked part of a rib is the upper part. If you insist on straightening it, you will break it. If you leave it, it will remain crooked. So, I entreat you to treat women well.” (Bukhari)

In Holy Quran, Allah Almighty says: “And of His signs are that He created for you from yourselves mates that you may find tranquility in them, and He placed between you affection and mercy. Indeed in that are signs for a people who give thought” (Quran, 30:21). Below we will discuss some basic rights of wives upon her husband or you can say the duties of the husband for their wiv
es.

  • To feed her, spend upon her in a way that Allah Almighty commanded in the Holy Quran. In one of the hadith Prophet Muhammad (SAW) said: ‘Give charity.’ A man said: ‘O Messenger of Allah, I have a Dinar.’ He said: ‘Spend it on yourself.’ He said: ‘I have another.’ He said: ‘Spend it on your wife.’ He said: ‘I have another.’ He said: ‘Spend it on your son.’ He said: ‘I have another.’ He said: ‘Spend it on your servant.’ He said: ‘I have another.’ He said: ‘You know best (what to do with it).”‘ (Sunan an-Nasa’i)
  • Give dowry to wife. In Holy Quran Allah (SWT) says about the right of dowry in these words: “And give women their dowries as a gift. Then, if they are pleased to give some of it to you, consume it with good health and enjoyment.”( Quran, 4:4)
  • Support is one of the most important rights of the wife over her husband. Allah Almighty says in the Holy Quran: “…And upon the father is the mother’s sustenance and her clothing according to what is reasonable. No person shall have a burden on him greater than he can bear…”(Quran, 2:233)
  • It’s the duty of the husband to be kind to her. Prophet (PBUH) said in one of His hadith: “The perfect man in his faith among the believers is the one whose behavior is most excellent, and the best of you are those who are the best to their wives.” (Tirmidhi)
  • A husband should not expose the secrets of his wife. The Messenger of Allah (SAW) said: “The wicked among the people in the eye of Allah on the Day of Judgment is the man who goes to his wife and she comes to him, and then he divulges her secret.” (Sahih Muslim)
  • The man must not curse or swear at his wife, or insult her appearance.
  • A man should not hate his wife. Allah’s Messenger (SAW) said: “A believer must not hate (his wife) believing woman; if he dislikes one of her characteristics he will be pleased with another”. (Muslim)

In short, it is proven that Islam gives women enough rights as a religion, it is then up to us, as men, to further their rights and help them attain the level of equality they deserve. May Allah Almighty give us the strength to live our lives according to Islamic teachings! Ameen.

Marriage And Divorce In Islam!

Marriage is a lawful union between man and woman based on mutual consent comprising devotion, intimacy, and respect of each other. Islam is the strongest advocate of marriage as it is a moral safeguard along social necessity. The purpose of marriage is to foster the state of companion between man and wife as it has declared half faith in Deen e Islam that utterly despises celibacy rooted deep in rest of the religions.




“When a person gets married he has completed half of his religion, so let him fear Allah with regard to the other half.” [Al Bayhaqi]

Nikkah Legalizes Marriage in Islam


A mere individual consent is not necessary but nikkah is the vital part to legalize marriage as per sacred scripture of Quran and Sunnah. Nikkah shatters half of the sins for a Muslim and it shields the person from fornication, adultery, and homosexuality.

Marriage in Islam is a divine bond between two souls for each other for comfort, companionship, and support hence has declared a sign of the glorified Lord as Quran states:






“And of His signs is that He created for you from yourselves mates that you may find tranquility in them, and He placed between you affection and mercy. Indeed in that are signs for a people who give thought.” [Quran 30:21]

Marriage is Prophet Sunnah


Prophet Muhammad (PBUH) was sent down with eminent messages regarding different perspectives of life including marriage. Muslims have awarded with the liability of choosing their life partners and have given the choice of rejection but on rational grounds. Prophet Muhammad (PBUH) is the role model for every single man on this earth. He called marriage His Sunnah and fulfilling Sunnah in itself holds gazillion virtues. Hadith narrates:

“It was narrated from Aisha (RA) that Allah’s Messenger (PBUH) said, “Marriage is a part of my Sunnah, and whoever does not follow my Sunnah has nothing to do with me” [Ibn E Majah]

Unfortunately, the fatal and socially curses custom of Dowry has made marriages complicated. This cultural aspect that is commonly followed in most of the Asian countries put undue pressure on the parents of the girl making it impossible for families to think of their daughter’s marriage. Islam has asked for a simple marriage withholding the rights of a woman along Haq E Mahar that is a safety bond for a woman after her marriage.

“The marriage that is most greatly blessed is the one, which is the lightest in burden [expense]. However, if people are well catered for, without extravagance and show, there is no problem with that either.” [Bayhaqi]
Lavishness is otherwise forbidden in Islam and Allah Almighty has refrained Muslims not to be among the wasters as stated: 
“… And be not excessive. Indeed, He does not like those who commit excess.” [Quran 6:141]

Qualities of a Spouse


Islam asked His followers to select a spouse of his own will yet it has stated certain prerequisites that entail her religion, nobility, character, firm faith, and synced compatibility. Allah has even warned the people that noble women are only for the nobleman hence seek what is better in their favor.
It was narrated from Abu Hurairah (RA) that Allah’s Messenger (PBUH) said, “A woman may be married for four things: her wealth, her lineage, her beauty or for his religion. Choose the religious, may your hands be rubbed with dust.” [Abu Dawud]

Divorce and Commands in Islam


Marriage is a contract and a contract is based on the certain criterion to fulfill. If any of the partners deviates and incur miseries upon other then Islam calls on for divorce. Divorce can be both from man or from the woman, former is known as Talaq and later is Khulah. Prophet Muhammad (PBUH) said about divorce that:
“Talaaq is the right of the one who seizes the leg (i.e., consummates the marriage)” i.e. the husband. [Ibn E Majah]
Divorce is otherwise the most cursed and loathsome ritual that Allah despises and ordered reconciliation in any such cases.
“The most hateful permissible thing (al-Halal) in the sight of Allah is divorce.” [Abu Dawud]

1. Mutual Divorce


In case of mutual divorce, there is no need to consult courts or elect arbitrators for reconciliations. The man must give divorce three times by fulfilling the rest of her rights like Haq Meher. The pronouncement of Talaq can be verbal or written depending on circumstances and the parties ought to accomplish three months period of iddat refraining from physical needs. The iddat is to prevent the person from making any hasty decisions in anger and anguish. In this entire period, Husband is responsible for fulfilling the responsibilities of his divorced wife.




“Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah….” [Quran 2:229]

2. Khulah (Ransom)


Khula is when a wife is not satisfied by her male partner’s responsibilities. In this case, she gets herself free from all liabilities in return for Haq Meher and takes separation.

“… And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah. But if you fear that they will not keep [within] the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. ” [Quran 2:229]

Conditions that make Divorce invalid


Despite aforementioned reasons, other there are certain conditions that nullify divorce like:
  • Anger invalidates Talaq as it is from Satan and provoke the person to utter senseless things. Hadith narrates:
“There is no divorce and no manumission in the event of ighlaaq (anger).” [Abu Dawud]
  • When a person is in an impure state and drunk then the divorce does not hold. In drunken cases, the mental strength of the person deludes and he is oblivion of what he has stated hence such Talaaqs are not valid. As Allah says in the Quran:

“O you who have believed, do not approach prayer while you are intoxicated until you know what you are saying or in a state of janabah….” [Quran 4:43]

  • In the state of menses and pregnancy, the different school of thoughts has different opinions hence the participants should consult Shariat courts and made further proceedings.

Surmising, the legal contract of marriage has its own charm and bounties hence Islam commands the couple to avoid any conflict that leads to divorce. Once divorced then shariat should be kept in consideration to avoid Allah’s wrath but the intention should be reconciliation prior to any permanent damage.
